IMPORTANT NOTICE

FlyToGlow is a technology platform that connects international customers with independent medical institutions in the Republic of Korea. FlyToGlow does not operate hospitals or clinics, does not provide medical treatment, does not diagnose medical conditions, does not prescribe medication, and does not guarantee medical results. All medical services are provided solely by independent, licensed Partner Clinics.

Nothing in these Terms excludes, restricts or modifies any consumer right or guarantee that applies to you under mandatory law in your country of residence and that cannot lawfully be excluded, restricted or modified by agreement.

1. PURPOSE AND ACCEPTANCE

These Terms of Service (“Terms”) govern your access to and use of flytoglow.com, our mobile or web-based services, AI Glow Check, booking functions, reviews, content, communications and related services (together, the “Service”).

By creating an account, submitting a booking request, using AI Glow Check, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and the policies referenced in Section 27. If you do not agree, you must not use the Service.

2. THE COMPANY AND OUR CORPORATE GROUP

The Service is operated by FlyToGlow Pte. Ltd., a company incorporated in Singapore (“FlyToGlow”, the “Company”, “we”, “us” or “our”).

Certain activities relating to the introduction and support of international patients in the Republic of Korea may be performed by or through our affiliates, including a Korean subsidiary of FlyToGlow that is (or will be) registered as a foreign patient attraction agency under the Act on Support for Overseas Expansion of the Healthcare Industry and Attraction of International Patients of Korea, where such registration is required by applicable law. References to FlyToGlow in these Terms include, where the context permits, such affiliates acting on our behalf.

3. DEFINITIONS

“Affiliate” means any entity that directly or indirectly controls, is controlled by, or is under common control with FlyToGlow Pte. Ltd., including any Korean subsidiary.

“AI Glow Check” means the artificial-intelligence-powered skin analysis feature offered through the Service for informational purposes only.

“Booking” means an appointment request, confirmed appointment, consultation request, reservation, package booking or other scheduled service arranged through the Service.

“Partner Clinic” means an independent, licensed healthcare provider in the Republic of Korea that has been approved to receive enquiries and Bookings through the Service.

“User”, “you” or “your” means any person who accesses or uses the Service.

4. ELIGIBILITY AND ACCOUNTS

You may use the Service only if you are at least 18 years of age (or the age of majority in your place of residence, if higher) and are legally capable of entering into a binding contract. The Service is not directed to minors, and minors may not create accounts, upload facial images or request Bookings.

When you create an account you must provide accurate, current and complete information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly at admin@flytoglow.com if you suspect any unauthorised access to your account.

You may hold only one account, and you may not transfer, sell or share your account with any other person. We may refuse registration, or suspend or terminate accounts, that are involved in fraud, abuse, illegal activity, impersonation, misuse of the Service or violation of these Terms.

5. ROLE OF THE PLATFORM

FlyToGlow acts solely as an intermediary marketplace and coordination platform. We are not a party to the medical relationship between you and any Partner Clinic.

All medical consultations, examinations, diagnoses, procedures, prescriptions, clinical decisions, informed-consent processes, aftercare and treatment outcomes are the sole responsibility of the relevant Partner Clinic and its licensed medical professionals. FlyToGlow does not supervise, direct or control the medical services of any Partner Clinic and does not endorse or guarantee any particular clinic, doctor, treatment or result.

6. MEDICAL DISCLAIMER

Information available on the Service, including treatment descriptions, category pages, price indications, FAQs, articles, reviews and AI Glow Check output, is provided for general information only and is not medical advice.

You must consult a qualified, licensed healthcare professional before undergoing any treatment. FlyToGlow does not guarantee:

• treatment availability;
• medical suitability of any procedure for you;
• medical or cosmetic results;
• recovery times; or
• the absence of side effects or complications.

Do not use the Service for medical emergencies. If you experience urgent symptoms, contact local emergency services or a hospital immediately.

7. AI GLOW CHECK

AI Glow Check is provided only as an informational technology tool to support your understanding of general treatment categories and your navigation of the Service. AI Glow Check output:

• is not a medical diagnosis, clinical assessment or treatment recommendation;
• may be inaccurate, incomplete, outdated or unsuitable for your circumstances;
• does not replace consultation with a licensed doctor; and
• must not be used for emergencies or urgent medical concerns.

You acknowledge that all final medical decisions must be made together with licensed medical professionals. Your use of AI Glow Check is also subject to the AI Glow Check Disclaimer, which forms part of these Terms.

8. IMAGE UPLOADS AND PROCESSING

You may voluntarily upload facial images and related skin information in connection with AI Glow Check or Booking coordination. Uploaded images may be processed for skin analysis, service delivery, Booking and consultation coordination with your selected Partner Clinic, troubleshooting and quality improvement, as described in our Privacy Policy.

You must upload only images of yourself, unless you have lawful authority and the informed consent of the person shown. You must not upload images of minors. We do not use identifiable facial images for advertising, marketing materials or public galleries without your separate, explicit consent.

9. BOOKING SERVICES

FlyToGlow facilitates appointment requests and Booking coordination between you and Partner Clinics. A Booking is not confirmed until the Partner Clinic accepts the request and any required deposit, payment or information has been completed.

Partner Clinics independently determine treatment availability, pricing, assigned doctors, medical decisions, clinic-specific policies and cancellation rules. Displayed prices may be estimates or starting prices, and the final scope and price of treatment may change after in-person consultation and clinical assessment.

10. MEDICAL TOURISM AND TRAVEL

You are solely responsible for your own travel arrangements and requirements, including passports, visas, flights, accommodation, travel and medical insurance, vaccinations and immigration requirements. FlyToGlow does not guarantee visa approval or entry into the Republic of Korea.

We strongly recommend that you do not purchase non-refundable travel products based only on a preliminary appointment request, and that you obtain travel and medical insurance appropriate to your trip and treatment.

11. PAYMENT TERMS

Payments made through the Service may be processed by third-party payment providers. By making a payment you agree to the terms of the applicable payment provider. Depending on the Booking, you may pay a deposit or prepayment through FlyToGlow and pay remaining amounts directly to the Partner Clinic.

To the extent permitted by law, FlyToGlow is not responsible for exchange-rate fluctuations, bank charges, card or network fees, or errors caused by payment providers or financial institutions. Amounts payable, applicable fees and any taxes will be presented to you before you confirm a payment.

12. CANCELLATIONS AND REFUNDS

Cancellations, rescheduling and refunds are governed by the FlyToGlow Refund & Cancellation Policy, together with any clinic-specific or booking-specific terms disclosed to you before you confirm a Booking. Nothing in this Section limits any non-excludable consumer rights available to you under applicable law.

13. USER CONTENT AND REVIEWS

You may submit reviews, ratings, comments, photographs and other content (“User Content”). You are responsible for your User Content and must ensure that it is truthful, lawful, based on your genuine experience, and does not infringe the rights of any person, including privacy and image rights.

You grant FlyToGlow a worldwide, royalty-free, non-exclusive, sublicensable licence to host, use, reproduce, translate, adapt, display and distribute your User Content for the purposes of operating, improving and promoting the Service. This licence does not apply to facial images or health-related information submitted for AI Glow Check or Booking coordination: such materials are processed only as described in our Privacy Policy and will not be used for advertising, marketing or public display without your separate, explicit consent.

We may moderate, translate, refuse, restrict or remove User Content that we reasonably believe is false, misleading, fraudulent, defamatory, abusive, privacy-infringing, unlawful or contrary to platform policy. We do not undertake to monitor all User Content and are not responsible for content submitted by users or clinics.

14. PROHIBITED ACTIVITIES

You must not:

• provide false, misleading or fraudulent information, or impersonate any person;
• misuse medical information or use the Service to harm yourself or others;
• violate any applicable law or regulation;
• upload unlawful, infringing, obscene or harmful content, or images of another person without consent;
• interfere with, probe, scrape, reverse engineer or attack the Service, its security or its infrastructure;
• use automated means to access the Service without our written permission;
• infringe intellectual property rights of FlyToGlow or any third party; or
• circumvent the platform, its fees or its safety processes.

15. INTELLECTUAL PROPERTY

The Service and all associated trademarks, logos, software, databases, AI systems, designs, text, graphics and other content (excluding User Content and Partner Clinic content) are owned by FlyToGlow or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purposes. No other rights are granted.

16. THIRD-PARTY SERVICES

The Service may integrate or link to third-party services, including payment processors, cloud providers, analytics tools, Partner Clinics, insurers and travel-related providers. Third parties are responsible for their own services, websites, terms and privacy practices, and your use of them may be subject to separate agreements between you and the relevant third party.

17. SERVICE AVAILABILITY AND CHANGES

We do not guarantee that the Service will be uninterrupted, error-free or secure. Temporary interruptions may occur due to maintenance, security events, technical failures or external providers. We may modify, add, suspend or discontinue features of the Service from time to time. Where a change materially and adversely affects a confirmed Booking, we will use commercially reasonable efforts to notify you and assist with alternatives or eligible refunds under the Refund & Cancellation Policy.

18. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis, and FlyToGlow disclaims all warranties, whether express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. This Section does not limit any warranty or guarantee implied by mandatory law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, FlyToGlow shall not be liable for:

• medical services, clinical decisions, treatment outcomes, complications or malpractice of any Partner Clinic or medical professional;
• indirect, incidental, special, punitive or consequential damages, or loss of profits, revenue, goodwill or opportunity;
• travel-related losses, including flights, accommodation, visas or insurance;
• acts or omissions of third parties, including payment providers; or
• decisions you make in reliance on information or AI output available on the Service.

To the maximum extent permitted by applicable law, the aggregate liability of FlyToGlow to you for all claims arising out of or relating to the Service in any 12-month period shall not exceed the total platform fees and other amounts paid by you to FlyToGlow (excluding amounts passed on to Partner Clinics or third parties) during that period, or SGD 100, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, and nothing in these Terms limits your non-excludable statutory consumer rights.

20. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless FlyToGlow, its Affiliates and their officers, directors, employees and agents from claims, losses, damages and reasonable costs arising from your violation of these Terms, your illegal activity, your provision of false information, your infringement of third-party rights, or your misuse of the Service. This Section does not apply to the extent a claim results from our own breach, negligence or wilful misconduct.

21. PRIVACY AND PERSONAL DATA

Your personal data is processed in accordance with the FlyToGlow Privacy Policy, which describes what data we collect, how we use it, how it is shared with Partner Clinics and Affiliates, cross-border transfers between Singapore, Korea and other countries, retention, security and your rights. We comply with the Singapore Personal Data Protection Act 2012 and other privacy laws applicable to our processing.

22. COMPLIANCE

You must comply with laws applicable to your use of the Service. FlyToGlow and Partner Clinics are required to comply with applicable healthcare regulations, medical advertising rules, privacy laws, consumer protection laws and anti-corruption requirements in the jurisdictions where they operate.

23. FORCE MAJEURE

FlyToGlow is not responsible for failure or delay caused by events beyond its reasonable control, including natural disasters, war, terrorism, epidemics or pandemics, government actions or restrictions, border closures, labour disruptions, power or internet failures, and failures of cloud, payment or communications infrastructure. Refund handling in such situations is described in the Refund & Cancellation Policy.

24. SUSPENSION AND TERMINATION

We may suspend or terminate your access to the Service, with notice where reasonably practicable, if you materially violate these Terms, if required by law, or if reasonably necessary to protect the safety or security of users, clinics, the public or the Service.

You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. Termination does not affect accrued rights or obligations, including payment obligations, and Sections that by their nature should survive (including Sections 13, 15, 18, 19, 20, 21, 28 and 29) survive termination.

25. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in law, our services or our business. The updated version will be posted on the Service with a revised effective date. For material changes we will provide reasonable advance notice, such as by email or in-Service notice. Your continued use of the Service after the effective date of updated Terms constitutes acceptance, except where your separate consent is required by law. If you do not agree to updated Terms, you must stop using the Service. The version of these Terms in effect at the time of a Booking applies to that Booking unless a later version is required by law or expressly accepted by you.

26. ELECTRONIC COMMUNICATIONS

You agree that we may provide notices, disclosures, agreements and other communications to you electronically, including by email, in-Service messages or posting on the Service, and that electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

27. RELATED POLICIES AND ORDER OF PRECEDENCE

The following documents are incorporated into and form part of these Terms: the Privacy Policy, the Refund & Cancellation Policy, the Cookie Policy, the AI Glow Check Disclaimer, and any booking-specific or campaign-specific terms disclosed to you before you confirm a Booking.

If there is a conflict between these Terms and another incorporated document, the document that provides the more specific rule for the relevant subject matter prevails, and booking-specific terms disclosed to you before confirmation prevail for that Booking, unless applicable law requires otherwise.

28. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of Singapore, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence that cannot be derogated from by agreement.

If a dispute arises, please contact us first at admin@flytoglow.com so that we can attempt to resolve it informally and in good faith. If a dispute is not resolved within 30 days of written notice, it shall be submitted to the exclusive jurisdiction of the courts of Singapore, except that (a) either party may seek urgent injunctive relief in any court of competent jurisdiction, and (b) consumers may bring proceedings in another forum where mandatory law grants them that right.

29. GENERAL PROVISIONS

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of that provision or of our right to enforce it later.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms to an Affiliate or to a successor in connection with a merger, acquisition, restructuring or sale of assets, provided your rights are not materially reduced.

Language. These Terms are prepared in English. Translations may be provided for convenience; in the event of any inconsistency, the English version prevails to the extent permitted by applicable law.

Entire agreement. These Terms, together with the documents referenced in Section 27, constitute the entire agreement between you and FlyToGlow regarding the Service and supersede prior agreements on the same subject matter.
